Terms of Service

Last updated: 15 October 2026

These Terms of Service ("Terms") govern your access to and use of Social Publish AI (the "Service"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.

1. Acceptance of Terms

By registering for, accessing, or using Social Publish AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a company or other organisation, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

The Service is built for business and professional use. By using it, you confirm that you are using it for your trade, business or profession, including as a creator, freelancer or agency.

2. Description of the Service

Social Publish AI is a social media management platform that lets you connect your social media accounts, create and schedule content, publish across multiple networks, collaborate with your team, and view analytics about your published content.

We may add, change, or remove features at any time to improve the Service. Where a change materially reduces the core functionality of a paid plan, we will provide reasonable advance notice.

3. Your Account

To use most features you must create an account. You are responsible for:

  • Providing accurate and complete registration information and keeping it up to date.
  • Keeping your password and login credentials secure and confidential.
  • All activity that happens under your account, including activity by team members you invite.
  • Workspaces and social accounts you manage for your own clients as an agency or freelancer, both to those clients and to us. These Terms apply to everything done in them.
  • Notifying us immediately at [email protected] of any unauthorised use of your account.

4. Acceptable Use

You agree not to use the Service to:

  • Post or share content that is unlawful, defamatory, harassing, hateful, sexually exploitative, deceptive, or that infringes the intellectual-property, privacy, or other rights of any person.
  • Send spam, engage in bulk unsolicited messaging, artificially inflate engagement, or otherwise violate the terms, community guidelines, or automation rules of any connected social network.
  • Upload malware, or attempt to gain unauthorised access to the Service, other users’ accounts, or our systems.
  • Scrape, harvest, or collect data from the Service or from connected platforms except as expressly permitted by those platforms.
  • Reverse-engineer, resell, sublicense, or misuse the Service or its underlying technology.
  • Misrepresent your identity or affiliation, or publish content on accounts you are not authorised to manage.
  • Share, sell, rent or transfer your account or your access to the Service, or use several accounts or workspaces to get around plan limits, rate limits or a suspension.
  • Place an unreasonable load on the Service, or interfere with or disrupt its systems or the systems of connected platforms.
  • Create, upload or publish any content that sexually exploits or endangers children. We remove such content and report it to the authorities.
  • Use AI features to create deceptive impersonations, deepfakes of real people without their consent, or election, health or financial misinformation.
  • Attempt, assist or encourage anyone else to do any of the above.

5. Monitoring, Limits and Enforcement

We may monitor and log use of the Service, including posting volume, timing and content patterns, to keep it secure, to detect spam and abuse, and to enforce these Terms and the rules of connected platforms. We are not obliged to monitor content.

We may set and change rate limits and usage limits. At any time and without notice, we may slow down, hold, cancel or remove any scheduled or published post, or pause publishing for an account or workspace, if we believe it breaks these Terms, the rules of a connected platform or the law, or puts the Service, other users or our access to a platform at risk.

We may report unlawful content, and the accounts behind it, to the platform concerned or to the authorities. To the maximum extent permitted by law, we are not liable for removing or holding content, for pausing publishing, or for failing to do so.

6. Third-Party Platforms & APIs

The Service connects to third-party social networks — including Facebook, Instagram and Threads (Meta), LinkedIn, X, YouTube (Google), TikTok, Pinterest, Reddit, Mastodon, and Bluesky — using each platform’s official APIs. Your use of each platform remains governed by that platform’s own terms and policies, and you agree to comply with them when publishing through the Service.

By connecting a YouTube account you also agree to be bound by the YouTube Terms of Service. Our use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

By connecting a Facebook, Instagram, or Threads account you acknowledge that our access to those accounts is governed by the Meta Platform Terms.

By connecting a LinkedIn account you acknowledge that our access to that account is governed by the LinkedIn API Terms of Use and the LinkedIn Developer Program policies, and that your own use of LinkedIn remains subject to the LinkedIn User Agreement. We access LinkedIn data only to provide the features you request, and we never sell it or use it for advertising.

By connecting a Reddit account you acknowledge that our access to that account is governed by the Reddit Responsible Builder Policy, the Reddit Developer Terms and the Reddit Data API Terms, and that your own use of Reddit remains subject to the Reddit User Agreement and Content Policy. Posts are submitted with your own account, to subreddits you choose, and you remain responsible for following each subreddit's rules. You may not use the Service to submit the same content to multiple subreddits, to post automated or spam content, or to manipulate votes or engagement. We never sell Reddit data, never use it for advertising, and never use it to train AI models.

Social Publish AI is an independent third-party application. We are not affiliated with, endorsed by, sponsored by, or officially partnered with LinkedIn Corporation, Meta Platforms, Google/YouTube, X Corp., TikTok, Pinterest, Reddit, Inc., or any other connected platform. All platform names and logos are trademarks of their respective owners and are used only to identify the services you can connect through the Service.

We are not responsible for changes, outages, or actions taken by third-party platforms, including if a platform limits, suspends, or revokes access to your connected account or changes its API in a way that affects a feature of the Service.

You can disconnect any linked social account at any time from the Accounts page in the Service, which stops all further access by us to that account.

7. Subscriptions, Billing & Refunds

Paid plans are billed in advance on a recurring basis (monthly or yearly) through our payment providers. Prices are shown on our Pricing page and include applicable taxes where indicated. By subscribing, you authorise recurring charges until you cancel.

You can cancel your subscription at any time from your billing settings; your plan remains active until the end of the current billing period, after which it will not renew. Except where required by law, payments already made are non-refundable.

AI features use AI credits. Each paid plan includes a monthly allowance of AI credits, shown on our Pricing page. Credits are used only when a generation succeeds, and the number an action uses follows what the AI provider charges us, so it can change when a provider changes its price; the app shows an estimate before you generate. Monthly credits reset at the start of each billing month and do not roll over.

You can buy one-time AI credit packs. Pack credits join your credit balance, are used after your plan’s monthly credits run out, and expire 12 months after purchase; unused pack credits expire with it. AI credits and packs have no cash value, cannot be transferred, and are not refundable, except where the law requires a refund (see our Refund Policy).

Posts to X use X credits, because X charges us for every post sent through its API. Each paid plan includes a monthly allowance of X credits, shown on our Pricing page. A plain post uses 1 credit and a post with a link uses more; the number follows what X charges us, so it can change when X changes its prices, and the composer shows what a post will use before you send it. Credits are used only when X accepts the post. When they run out, posts to X are refused until the allowance refills on the 1st of the next month (UTC); your other networks are not affected. X credits do not roll over, have no cash value, cannot be transferred and are not refundable.

If a payment fails, we may suspend or downgrade your access until the balance is settled. We may change plan prices with at least 30 days’ notice; changes apply from your next billing cycle.

8. Your Content

You retain all ownership of the content you create, upload, or publish through the Service ("Your Content").

You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, process, and transmit Your Content solely as needed to operate and provide the Service — for example, to schedule and publish a post to a social network on your instruction. This licence ends when you delete Your Content or your account, except where a copy must be retained for legal reasons.

You represent that you own or have the necessary rights to Your Content and that publishing it through the Service does not violate any law or the rights of any third party. You are solely responsible for Your Content.

9. AI Features and AI-Generated Content

The Service includes optional AI features that write captions, suggest hashtags, create images, repurpose posts, answer questions and draft or publish posts through an AI agent. AI output is generated automatically and may be inaccurate, incomplete, out of date, offensive, biased, similar to content created for others, or infringe the rights of third parties.

You should review AI output before you publish it, unless you choose to let an AI agent post automatically under our AI-Generated Content Terms. You are solely responsible for all content published from your account, including content created with AI features and content published automatically by an AI agent, auto-post, RSS, repeat or any other automation you switched on.

When you let an AI agent post automatically, our AI-Generated Content Terms also apply, and you accept them in the app before the agent can post without review.

AI output is not legal, financial, medical, tax or other professional advice. We do not warrant that AI output is accurate, original, lawful or free of third-party rights, and we are not liable for AI output or for the consequences of publishing it.

10. Our Intellectual Property

The Service, including its software, design, logos, and all related intellectual property, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business or personal use in accordance with these Terms. No other rights are granted.

11. Termination

You may stop using the Service and delete your account at any time from your account settings. Deleting your account disconnects all linked social accounts and deletes your data as described in our Privacy Policy.

We may suspend or terminate your account or your access to the Service, in whole or in part, at any time and for any reason, with or without notice, including immediately if we believe you have broken these Terms or the rules of a connected platform, or to protect the Service, other users or our access to third-party platforms. To the maximum extent permitted by law, we are not liable to you for any suspension or termination. If we terminate your account for a reason other than your breach of these Terms, we will refund the unused part of any fees you prepaid.

When your account is terminated: your right to use the Service ends at once; scheduled posts are cancelled; any amount you owed before termination remains payable; licences granted to us over Your Content end, subject to legally required retention; and we may delete your content as described in our Privacy Policy, so keep your own copies.

If we terminate your account because you broke these Terms, you may not create a new account, or use someone else's account, without our written permission.

The sections on Your Content, AI Features and AI-Generated Content, Disclaimer and Limitation of Liability, Events Beyond Our Control, Indemnification, Governing Law & Contact and General, and any amount you owe us, continue to apply after termination.

We may change, suspend or discontinue the Service, or any part of it, at any time. If we discontinue a paid plan you have already paid for, we will refund the unused part of the fees you prepaid for it; that refund is your only remedy for the discontinuation.

12. Disclaimer and Limitation of Liability

In this section, "we" and "us" include our affiliates and our and their directors, officers, employees, agents, suppliers and licensors.

To the maximum extent permitted by applicable law, the Service, and all content, analytics and AI output made available through it, are provided "as is", "as available" and "with all faults", and you use them at your own risk.

To the maximum extent permitted by applicable law, we disclaim all warranties, conditions and representations of any kind, whether express, implied or statutory, or arising from course of dealing, course of performance or usage of trade, including any implied warranties or conditions of merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, accuracy and non-infringement.

Without limiting the above, we do not warrant that: (a) the Service will meet your requirements or produce any particular business, marketing, engagement, follower-growth, reach or revenue outcome; (b) the Service will be uninterrupted, timely, secure or error-free, or that any error will be corrected; (c) any post will be published, published at the scheduled time, published only once, or remain published; (d) any content, analytics or AI output will be accurate, complete, reliable, lawful, original or non-infringing; (e) the Service or any file it delivers will be free of viruses or other harmful components; or (f) your data or content will not be lost, corrupted or disclosed. You are responsible for keeping your own copies of your content.

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business opportunities, data, goodwill, followers, engagement or reach, or for the cost of substitute services, arising out of or relating to the Service or these Terms, including failures, delays, interruptions, suspensions of your accounts, or changes involving third-party platforms, APIs or services, and including unauthorised access to or alteration of your data, whatever the legal theory (contract, tort including negligence, strict liability or otherwise), and even if we were told such damages were possible.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the fees actually paid by you to us for the Service during the 12 months before the event giving rise to the claim, and (b) US$100.

We do not control third-party platforms and are not responsible for their independent acts, omissions, outages, policy changes, API changes, account restrictions, or decisions, except to the extent liability cannot lawfully be excluded.

These limitations apply even if a limited remedy fails of its essential purpose. They are an essential part of the agreement between you and us, and the Service could not be offered at its current prices without them.

To the extent permitted by applicable law, any claim arising out of or relating to the Service or these Terms must be brought within one year after it arose; otherwise it is permanently barred.

Nothing in these Terms excludes or limits any liability, right, or remedy that cannot be excluded or limited under applicable law. Where the law does not allow a limitation, our liability is limited to the fullest extent the law permits.

13. Events Beyond Our Control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages, restrictions or changes of social networks, APIs, hosting, storage, payment or AI providers, failures of the internet, power or telecommunications, cyberattacks, natural disasters, epidemics, war, terrorism, strikes, or acts of government.

14. Indemnification

You agree to defend, indemnify and hold harmless us, our affiliates, and our and their directors, officers, employees and agents from and against all claims, damages, losses, liabilities, penalties, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content, including content created with AI features and content published by automations you switched on; (b) your use of the Service or of any connected third-party platform; (c) workspaces and social accounts you manage for your own clients; (d) your breach of these Terms or of any third-party platform's terms or policies; or (e) your violation of any law or of the rights of any third party.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms; if you do not agree, you may stop using the Service and cancel your account.

This version is effective on 15 October 2026 for accounts created on or after that date. For accounts created before it, this version takes effect on 28 October 2026, and the previous version applies until then.

16. Governing Law & Contact

Social Publish AI is offered to customers worldwide. These Terms are governed by the laws of India, where Social Publish AI is registered, without regard to conflict-of-law principles, and disputes are subject to the jurisdiction of the courts located in India.

If you use the Service as a consumer, nothing in these Terms takes away the protection of the mandatory consumer laws of the country where you live.

17. General

If any part of these Terms is found invalid or unenforceable, it is limited to the minimum extent necessary and the rest of these Terms stays in full effect. Our failure to enforce any right is not a waiver of it.

These Terms and our Privacy Policy are the entire agreement between you and us about the Service. You may not transfer your rights under these Terms without our written consent; we may transfer ours as part of a merger, acquisition, or sale of assets.
